Nechmya and his Platoon were involved in using prisoners as human shields, looting and forced displacement of civilians in Gaza.

Kathmandu, Nepal – The Hind Rajab Foundation (HRF) has officially filed a formal request with the Nepalese authorities to immediately arrest Lieutenant Amit Nechmya and extradite him to Argentina, where a legal case remains open against him for war crimes, crimes against humanity, and genocide.

Lieutenant Nechmya, a platoon commander in the Latak Platoon of the Givati Brigade’s Rotem Battalion (435), is currently vacationing in Nepal in an apparent attempt to evade justice. On January 2, 2025, HRF filed a case in Buenos Aires, where Nechmya was vacationing, charging him with multiple grave violations under international law.
Since then, new evidence has emerged confirming Nechmya’s efforts to destroy critical proof of his involvement in war crimes committed in Gaza, further underlining the urgency of his apprehension. The case against him includes:

  • Use of Human Shields in Jabalia and Rafah, as documented by video footage showing blindfolded Palestinians used for protection by soldiers under his command.
  • Looting and Destruction of civilian property in Rafah and Gaza City, including the theft of personal belongings and deliberate targeting of homes.
  • Forced Displacement Orders in Khan Younis, backed by witness testimonies and audio recordings of Nechmya instructing the demolition of inhabited civilian homes.

These actions violate several provisions of the Rome Statute, notably:

  • Article 8(2)(b)(xxiii): Use of human shields
  • Article 8(2)(a)(ii): Inhumane treatment
  • Articles 7(1)(d) and 7(1)(h): Forced displacement and persecution

Call to Nepalese Authorities: We urge the Government of Nepal to fulfill its international legal obligations and:

  1. Arrest Lieutenant Amit Nechmya without delay;
  2. Prevent any attempt by him to flee the country;
  3. Coordinate with Argentine judicial authorities and Interpol to ensure his extradition for prosecution.

The Hind Rajab Foundation stands firm in its commitment to end impunity for perpetrators of atrocities in Gaza. No matter how far they travel or how desperately they hide, justice will pursue them.
